Liability policy

  • 1. Purpose

    VenWed is an online marketplace that connects couples with wedding venues and vendors. This Liability Policy explains the scope of VenWed’s responsibility and clarifies the responsibilities of venues, vendors, and couples who use the platform.
  • 2. VenWed’s Role

    • VenWed is not a party to contracts, agreements, or arrangements made between venues, vendors, and couples.
    • VenWed provides a platform to facilitate listings, bookings, deposits, payments, and communication but does not manage, own, operate, or control any venue or vendor services.
    • VenWed does not verify or guarantee the performance, safety, legality, accuracy, availability, or suitability of any venue or vendor listed on the platform, except where explicitly marked with a VenWed verification badge.
    • VenWed does not supervise, direct, or guarantee the conduct of venues, vendors, or couples.
  • 3. User Responsibilities

    Venues & Vendors:
    • Responsible for the accuracy and legality of their listings.
    • Must comply with all applicable laws, regulations, licenses, permits, and insurance requirements.
    • Responsible for fulfilling services and honoring cancellation, refund, and rescheduling policies selected on VenWed.
    Couples (Customers):
    • Responsible for reviewing venue/vendor policies, contracts, and payment terms before booking.
    • Responsible for complying with venue/vendor rules and requirements during events.
    All Users:
    • Agree to comply with applicable laws and VenWed’s Terms of Service.
    • Agree not to misrepresent information, engage in fraud, or use VenWed for unlawful purposes.
  • 4. Liability Limitations

    VenWed shall not be liable for:
    • Injuries, damages, losses, or claims arising from events, services, or use of a venue/vendor.
    • Cancellations, no-shows, double-bookings, or service failures.
    • Losses related to venue/vendor policies, contracts, or customer disputes.
    • Fraudulent activity, misrepresentation, or misconduct by venues, vendors, or users (though VenWed may take measures to investigate and remove bad actors).
    • Any indirect, incidental, consequential, or punitive damages.

    Limitation of Liability: To the fullest extent permitted by law, VenWed’s liability shall be limited to the lesser of:
    (a) the total service fees paid by the affected party to VenWed in connection with the disputed booking, or
    (b) $500.

  • 5. Insurance & Risk Allocation

    • Venues & Vendors: Strongly encouraged, and in some cases required, to carry general liability insurance covering their services, property, and guests.
    • Couples: Encouraged to purchase wedding or event insurance to cover unforeseen cancellations, damages, or losses.
    • VenWed: May provide or integrate optional insurance offerings, but responsibility for securing adequate coverage rests with venues, vendors, and couples.
  • 6. Indemnification

    By using VenWed, users agree to indemnify, defend, and hold harmless VenWed, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:
    • Their use of the VenWed platform;
    • Their violation of VenWed’s Terms of Service, this Liability Policy, or applicable laws;
    • Their negligence, fraud, or misconduct.
  • 7. Dispute Resolution

    • VenWed may provide tools to facilitate communication and dispute resolution but is not obligated to mediate or intervene.
    • All disputes, chargebacks, cancellations, or service disagreements must be resolved directly between the couple and the venue/vendor.
    • VenWed is not responsible for enforcing venue/vendor policies or refund obligations beyond the scope of its service fee facilitation.
  • 8. Policy Updates

    VenWed reserves the right to update or modify this Liability Policy at any time. Updates are effective upon posting to the platform. Continued use of VenWed after changes constitutes acceptance of the revised Policy.
